Workers' compensation

Q: Workers' compensation is an allowable fringe benefit, but in our state there are two parts to the workers' compensation: an employer contribution and an employee withholding. Some employers in the state pay the employee withholding as a benefit to employees. Can SCSEP funds be utilized to pay both parts of the workers' compensation or are they restricted only to being used for the employer contribution?

A: The Washington statute allowing for worker payroll deductions for workers compensation appears to be rare, if not unique. Because workers compensation is a fringe benefit required by the OAA, DOL has determined that it must be provided by the grantee at no cost to participants. The full cost should be charged to PWFB.
